Default Tenant Eviction in Mexico

I am in the unfortunate position of having a tenant in SMA Mexico who has stopped paying rent. Thery are Mexican Nationals. I would appreciate information/ advice as to how I might resolve this situation, and or any one elses experience of this type.

I have no hard information on these situations, but I have heard countless times that getting tenants out of a rental house in Mexico can be a major pain in the backside. The laws here appear to favor the "downtrodden" tenants. Part of all that bogus "revolutionary" stuff. When and if you get them out, I recommend renting to Gringos in the future. SMA is full of them. And they are probably less likely to pull this stunt.

I'm assuming that you've used the services of an attorney in SMA prior to this point for matters such as real estate purchase, immigration matters, etc. If so, speak with that person about what to do. If you don't have an existing relationship with an attorney, you should. Don't let the situtation fester. Hopefully, you've a signed rental agreement and good records of the relationship. Also, if they've stopped paying you maybe they've stopped paying utilities (some or all of which may be in your name as the property owner). Property owners are ultimately responsible for utility payments, no matter the understanding with the tenant. This is something you should check on if you might have liability. Bite the bullet and pay to have a professional give you advise and/or handle the matter for you.
