Just wondering if anyone knows if I need a FM3 to move to mexico and open up a business that would employ local help?

Yes FM2 is preferred but you can get an FM3 with a work permit. Depending on what type of business you plan on opening the FM3 is the least of your worries.

Is it very difficult for foreiners to open up a business in mexico? Is it possible to achieve this within 3 month time frame (to get the permits and such)? And is it possible to open a business with just a tourist visa?

coldin alberta: Do you have a business plan? Have you been in contact with the business development dept. of that particular state? Are you sure your business is wanted or needed? Tell us a little more. Sounds like you are not ready. Are you prepared to deal with Mexican Labor laws? Do you have a Mexican attorney? Do you speak Spanish? Where are you going to live? Do you know the cost of water taxes, electricity, etc.? Mexico is not Niravana.

It's not difficult for foreigners to open most businesses in Mexico, but it probably does take longer to accomplish the task than the same process in many other countries. The key to doing this in Mexico is to find someone you can trust who's qualified. Locating a good local attorney and Notario Publico in the town/city you're interested in doing business in is what you should probably be concentrating on. These professionals will guide you through the process. If you're thinking about some sort of retail business, you may not be able to actually work up front with the public because of restrictions, but can work in the back of the house. The attorneys will also advise you about the visa process. Corporations can be formed in several weeks, but getting approvals of other various government entities (such as the tax-collecting Hacienda) and immigration matters can take a month or two. Check with the American Consulate in Cancun for a list of attorney's in PDC who are known to consular officials to have had successful/honest dealings with foreingers.
